By making a deposit or payment, the traveler (“Traveler,” “you,” or “your”) acknowledges that they have read, understood, and agreed to these Terms.
1. RESERVATIONS AND BOOKING
-
A reservation is not confirmed until Africa With Comfort has received the required deposit and issued written confirmation.
-
Safari itineraries, accommodations, transportation, activities, guides and other services remain subject to availability until confirmed.
-
The person making a reservation on behalf of multiple travelers represents that they are authorized to make the booking and provide information on behalf of the other travelers. Each adult traveler is responsible for reviewing and accepting these Terms.
2. PAYMENT SCHEDULE
Unless otherwise stated in your written itinerary or booking confirmation:
-
At booking: 25% of the total trip price is due.
-
120 days before departure: An additional 25% of the total trip price is due.
-
60 days before departure: The remaining 50% balance is due.
-
Reservations made within 60 days of departure require payment in full at the time of booking.
-
Certain lodges, camps, airlines, permits, park authorities or other suppliers may require earlier, larger or nonrefundable payments. Any different payment requirements applicable to your itinerary will be disclosed before confirmation whenever reasonably possible.
-
Failure to make a required payment by its due date may result in cancellation of the reservation and application of the cancellation provisions below.
3. PAYMENT METHODS
-
Africa With Comfort may accept payment by ACH/bank transfer, wire transfer, credit card or other approved payment methods.
-
ACH or bank transfer may be designated as the preferred payment method for certain transactions.
-
Payments are considered received only after funds have successfully cleared.
-
Any bank, wire, foreign-exchange or other charges imposed by a Traveler's financial institution are the Traveler's responsibility.
4. PRICES
-
Prices are based upon the itinerary, accommodations, transportation, park fees, government charges, taxes, exchange rates and supplier rates applicable when the quotation is prepared.
-
Unless expressly stated otherwise, prices are quoted in U.S. dollars.
-
Before final payment, Africa With Comfort reserves the right, to the extent permitted by applicable law, to adjust the price when unavoidable increases occur in government taxes or fees, park/conservation fees, transportation charges, supplier charges, exchange rates or other costs beyond our reasonable control.
-
Any material price change will be communicated to the Traveler.
5. CANCELLATIONS BY THE TRAVELER
-
Cancellation requests must be submitted to Africa With Comfort in writing.
-
Unless different terms were disclosed for a particular itinerary, the following cancellation charges apply:

-
No refund will ordinarily be provided for unused accommodations, meals, transportation, sightseeing, activities or other services voluntarily missed by the Traveler after the trip has begun.
-
6. TRAVEL INSURANCE
-
Comprehensive travel insurance is strongly recommended.
-
Travelers should consider coverage for trip cancellation, trip interruption, medical treatment, emergency evacuation and repatriation, baggage loss or delay, travel delays and other unexpected events.
-
Travelers should carefully review the terms, exclusions and coverage limits of any insurance policy.
-
Unless expressly stated otherwise, travel insurance is not included in the safari price.
7. PASSPORTS, VISAS AND ENTRY REQUIREMENTS
-
Each Traveler is responsible for obtaining and carrying all required passports, visas, electronic travel authorizations, vaccination documentation and other travel documents.
-
Passport validity and blank-page requirements vary by country and may change.
-
Africa With Comfort may provide general information regarding entry requirements as a convenience, but government requirements can change without notice. Travelers are responsible for verifying current requirements with the appropriate government authorities before departure.
-
Africa With Comfort is not responsible for losses resulting from a Traveler's failure to possess required documentation or satisfy immigration, customs, health or entry requirements.
8. HEALTH, VACCINATIONS AND MEDICAL CONDITIONS
-
Travel in Africa may involve remote locations, high altitude, rough terrain, wildlife, insects, heat, dust, limited medical facilities and extended travel by road or small aircraft.
-
Travelers are responsible for determining whether they are medically and physically capable of participating in their itinerary.
-
Travelers should consult qualified healthcare professionals regarding vaccinations, medications, malaria prevention and other health precautions appropriate for their destinations.
-
Travelers should advise Africa With Comfort before travel of mobility limitations, dietary requirements or other circumstances requiring special arrangements so that we can determine whether reasonable accommodations may be available.
-
Africa With Comfort does not provide medical advice.
9. SAFARI AND WILDLIFE CONDITIONS
-
Wildlife viewing occurs in natural environments. Africa With Comfort cannot guarantee sightings of particular animals or specific wildlife events.
-
Road conditions, weather, animal movements, park regulations and other local circumstances may affect game drives and other activities.
-
Travelers must follow safety instructions provided by guides, camp personnel, park officials and other authorized personnel.
-
Leaving vehicles or designated areas without authorization may be dangerous and is prohibited where instructed.
10. ITINERARY CHANGES
-
African safari travel requires flexibility.
-
Africa With Comfort and its suppliers may make reasonable changes to accommodations, routes, transportation, activities, guides or schedules when necessary because of weather, road conditions, wildlife movements, government action, safety concerns, flight changes, supplier availability or other circumstances.
-
When reasonably possible, substitute services will be of a comparable standard.
-
An itinerary description represents the planned trip but should not be interpreted as a guarantee that every activity will occur exactly as described or at a particular time.
11. AIR TRANSPORTATION
-
International and domestic flights may be operated by independent airlines and are subject to the carrier's own terms and conditions.
-
Airlines may change schedules, aircraft, routes or baggage allowances.
-
Safari itineraries may include light aircraft with strict baggage weight and size restrictions. Travelers are responsible for complying with applicable baggage requirements.
-
Africa With Comfort is not responsible for airline schedule changes, cancellations, missed connections or baggage issues caused by an independent air carrier, except to the extent required by applicable law.
12. INDEPENDENT SUPPLIERS
-
Africa With Comfort arranges services that may be provided by independent third parties, including hotels, lodges, camps, airlines, charter operators, transportation companies, safari operators, guides and activity providers.
-
These suppliers are independent businesses and are not employees of Africa With Comfort.
-
To the extent permitted by law, Africa With Comfort is not responsible for negligent or wrongful acts or omissions of independent suppliers over whom Africa With Comfort does not exercise direct control.
-
Nothing in these Terms is intended to waive rights that cannot legally be waived.
13. FORCE MAJEURE AND EVENTS BEYOND OUR CONTROL
-
Africa With Comfort will not be responsible for failure to perform services when performance is prevented, materially affected or made unsafe by circumstances beyond our reasonable control.
-
Such circumstances may include severe weather, natural disasters, wildfire, flood, epidemic or pandemic, war, terrorism, civil unrest, government action, border closures, strikes, transportation disruption, airline cancellations, park closures or similar extraordinary events.
-
When such an event occurs, Africa With Comfort will make reasonable efforts to assist Travelers with available alternatives.
-
Additional costs resulting from such circumstances may be the Traveler's responsibility, subject to applicable law and the terms of any travel insurance coverage.
14. TRAVELER CONDUCT
-
Travelers are expected to behave respectfully toward guides, staff, other guests, local communities and wildlife.
-
Africa With Comfort or its suppliers may terminate a Traveler's participation if the Traveler's conduct creates a significant safety risk, seriously disrupts the trip, threatens wildlife or other persons, or violates applicable law.
-
A Traveler removed for such conduct may be responsible for resulting costs and may not be entitled to a refund, to the extent permitted by law.
15. ASSUMPTION OF INHERENT TRAVEL RISKS
-
Safari and international travel involve inherent risks, including encounters with wild animals, uneven terrain, road travel, remote locations, weather, insects, illness and limited access to medical facilities.
-
By participating, Travelers acknowledge these inherent risks and accept the ordinary risks associated with the activities they voluntarily undertake.
-
This provision does not release Africa With Comfort from liability that cannot legally be excluded or limited.
16. BAGGAGE AND PERSONAL PROPERTY
-
Travelers are responsible for their passports, money, electronics, jewelry, medications, baggage and other personal property.
-
Travelers should use hotel or lodge safes when available and obtain appropriate insurance for valuable belongings.
-
Africa With Comfort is not responsible for lost, stolen or damaged property except where liability is imposed by applicable law.
17. PHOTOGRAPHY AND PRIVACY
-
Travelers should respect local customs and obtain permission before photographing individuals where appropriate.
-
Africa With Comfort will handle personal information provided in connection with a booking in accordance with its applicable privacy practices and legal obligations.
-
A Traveler's image will not be used for Africa With Comfort promotional purposes solely by virtue of accepting these Terms. Any promotional use requiring consent will be handled separately.
18. REFUNDS
-
Approved refunds will be returned using a reasonable payment method after Africa With Comfort determines the amount recoverable from applicable suppliers.
-
Supplier refunds may take time to process, particularly for international transactions.
-
Africa With Comfort cannot refund amounts that a supplier lawfully retains under applicable booking terms unless Africa With Comfort has separately agreed in writing to assume that obligation.
19. CHARGEBACKS AND PAYMENT DISPUTES
-
Travelers should contact Africa With Comfort promptly regarding any billing or service concern so that we have an opportunity to investigate and resolve the matter.
-
Nothing in these Terms restricts a Traveler from exercising lawful rights available through a bank, credit-card issuer or applicable consumer-protection law.
20. COMPLAINTS
-
Travelers should report significant problems as soon as reasonably possible during the trip so that Africa With Comfort or the applicable supplier has an opportunity to address them.
-
Post-trip complaints should be submitted in writing with relevant supporting information.
21. LIMITATION OF LIABILITY
-
To the maximum extent permitted by applicable law, Africa With Comfort's responsibility is limited to losses directly attributable to its own acts or omissions and does not extend to losses caused solely by independent suppliers or circumstances outside its reasonable control.
-
No provision of these Terms limits liability where such limitation is prohibited by law.
22. GOVERNING LAW
-
These Terms and any dispute arising from a booking with Africa With Comfort will be governed by the laws of Tanzania.
-
Any forum-selection, arbitration or other formal dispute-resolution provision should be separately reviewed and approved by Africa With Comfort's legal counsel before being incorporated into these Terms.
23. SEVERABILITY
-
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
24. CHANGES TO THESE TERMS
-
Africa With Comfort may update these Terms periodically.
-
The Terms applicable to a particular booking will generally be the version accepted in connection with that booking, except where a change is required by law or subsequently agreed to by the parties.
25. ENTIRE AGREEMENT
-
These Terms, together with the Traveler's confirmed itinerary, invoice and any itinerary-specific written terms, constitute the agreement concerning the booking and supersede prior discussions concerning those matters.
-
If itinerary-specific written terms conflict with these general Terms, the itinerary-specific terms will control for that booking to the extent of the conflict.
26. ACCEPTANCE
-
By submitting a deposit or other payment after being provided these Terms, the Traveler acknowledges that they have had an opportunity to review the Terms and agrees to be bound by them.
